Returns & Refunds

If you are dissatisfied with an item purchased from our website you may return it to the address provided below for a refund, replacement or exchange provided that the conditions of our Refund & Exchange policy have been satisfied.

We will exchange or refund a product provided that:

  1. there is valid proof of purchase, i.e. credit card statement;
  2. it is within 6 months of the original purchase date;
  3. it is in its original packaging or condition, i.e the security seal or shrink wrap is intact (if applicable), product is unworn and unused and the online store’s price ticket is attached.
  4. For hygiene reasons, underwear including swimwear (excluding bras) may not be returned or exchanged.
  5. All refunds are processed strictly in accordance with the original sales tender type and only after confirmation that the funds were received in our bank account.
  6. If you wish to exchange/return something that you purchased online at and have met the above conditions for refund or exchange, you can do so as follow:

If you wish to return something that you purchased online at because the item you received is either damaged or not what you ordered, you can do so as follow:

  • Email and request Hikers Edge Pty Ltd to collect the product in question within 48 hours of receiving the goods. Hikers Edge Pty Ltd will send a courier to collect the damaged/incorrect product, at our own cost, and replace it with the correct product.

Our website is encrypted (that’s why you see that little lock icon in the URL bar) to keep your information secure. All the information you put into the site is encrypted for your security. For credit card payments, we only use trusted and  reputable payment systems, all approved by South African banks to process credit card payments. No credit-card data is stored on our site.

Delivery Policy & Order Tracking

The following Delivery Policy is only valid for merchandise purchased via the Hikers Edge website (“the Webstore”). This policy has been developed to ensure the accurate and secure delivery of all purchases according to your delivery needs. Should you have any questions with regards to deliveries, please contact us toll free on +27 76 697 9617.

  1. Free shipping for orders over R800 applies to main centres in South Africa only and it excludes large and heavy items.
  2. We can only deliver products to physical addresses within the borders of the Republic of South Africa.
  3. Deliveries will be made within 3-14 business days upon acceptance of your order.Next Day Delivery is subject to stock availability and only applies to items accordingly identified. Orders placed on a Friday will be delivered on the following Monday or when stock has been received from our suppliers. In the case of a mixed basket, our standard delivery policy of 3-14 working days will apply.Please note: Applies to main centres only.
  4. Quoted delivery times are a guide only and while Hikers Edge Pty Ltd endeavours to meet the targeted delivery times for both Next Day delivery and Standard deliveries, from time to time factors beyond our control can result in delayed delivery.
  5. A unique order number will be communicated to you via email which can be used to track the status of your order.
  6. Your deliveries will be made through one of our designated courier companies, Dawnwing, Ram Couriers, The Courrier Guy, DHL or Speed Services that delivers to Post Offices.
  7. Once you have indicated your address and you have received confirmation of your order, we regret that no changes to the specified address and/or delivery option will be accepted.
  8. We reserve the right to contact customers and arrange alternative delivery methods and timelines if their delivery address is remote or to cancel the order if delivery is not feasible.

  10. Before you finalise your order, you have the option to indicate in the “notes” field whether the order should only be delivered to you OR you can specify an alternative authorised person’s name to receive it on your behalf. You or the authorised person will be required to show proof of identification to the courier upon delivery.
  11. In order to safeguard your purchase, the courier will only deliver to the specified address and to you or one of the people indicated on the notes of the order as being authorised to receive your parcel.
  12. The courier will request proof of identity from the person receiving the parcel if this was indicated in the “notes” field of the order.
  13. All parcels delivered will be secured with a unique purchase sealing tape. Should this be broken, please follow the guidance below in point 16.
  14. The person receiving the parcel will be asked by the courier to sign the waybill indicating that the parcel/carton has been received undamaged and in good condition.
  15. Proof of ID may be requested to verify authenticity of purchaser.
  16. In the unlikely event that the parcel/carton is damaged and/or the security seal is broken, then the receiving person can either:
    1. Check the parcel in front of the driver and indicate on the courier’s waybill (delivery documentation) whether there are any Both parties (the courier and the person receiving) will need to co-sign their names against this indication. If the receiving person chooses to still accept the damaged carton, the waybill will reflect that a damaged parcel was received and accepted with both parties co-signing.

      • damages and/or
      • items missing.
    2. Alternatively, the receiving person can send the parcel back and indicate on the waybill the reasons for sending the parcel back. Both parties will need to co-sign against this indication.

We use two service providers to process our payments:

For your security, we don’t take any credit card numbers over the phone or by email. If you pay via credit card, our secure site will take you to our 3rd party payment page for you to enter your card details after selecting the “Place Order” button. 3D secure payment confirmation will also happen here. Upon completion you will be taken to the order confirmation page.

3D Secure? What’s That?

It’s an authentication system that adds an extra layer of protection against fraud. All South African banks use 3D SecureCode to protect their clients, which is great for us but not so good for credit card fraudsters.

To activate your Secure Internet Shopping, contact your Bank to activate your Credit Card with 3D SecureCode. You can usually do this on your online banking system. You will need your cellphone handy as your Bank will contact you via SMS with your Secure Code.

Proof Of Payment

If you are paying by credit card, there is no need to send us proof of payment – it happens automatically (ah, the wonders of technology). If you are paying by EFT or direct deposit, please email your proof of payment to If we do not receive your POP we will wait until your payment reflects on our bank statement. (This may take up to 3 days, depending on your bank.) If payment is made in a Foreign currency, we will need it to clear in our account before we can process your goodies!

Can I Pay COD?

We outsource delivery to third party couriers, so they cannot accept payment. All orders need to be paid for before they are dispatched, so Cash On Delivery is not possible.

Fraud & Security Checks

We do strict fraud checks to prevent criminal and fraudulent activity, as well as using 3D Secure to reduce fraud. We report all fraudulent activity to the necessary officials.

  • Registration and Use of the Website

    5. Hikers Edge may from time to time require you to change your Access Codes, as the case may be, and you undertake to comply with such instruction immediately.

You agree that Hikers Edge will accept and process your order for Products once the correct Access Codes have been entered, irrespective of whether the use of the Access Codes is unauthorised or fraudulent and that you will be liable for payment of such order, save where the order is cancelled by you in terms of these Terms.
    7. By using the Website you warrant that you are 18 (eighteen) years of age or older and of full legal capacity. If you are under the age of 18 (eighteen) or if you are not legally permitted to enter into a binding agreement, then you may use the Website only with the involvement and supervision of your parent or legal guardian.   • Verification

    1. You agree that all instructions, consents, orders and other communications which purport to originate from you or a person who had authority to act on your behalf to operate automatically (unless it is proved that such information system did not properly execute such programming) (collectively “the originator”) and which are sent to Hikers Edge electronically and which may (as a result of interception, equipment malfunction, the distortion of communication links or any other reason whatsoever) be different from the instructions actually sent or given, or may not have been given by you at all, shall be deemed to have been given by the originator in the form actually received by Hikers Edge and you will be bound by such instruction with no liability of whatever nature attaching to Hikers Edge in regard thereto.

You waive any rights that you may have or obtain against Hikers Edge arising directly or indirectly from any loss or damage of whatsoever nature which you may suffer as a result of the fact that Hikers Edge acts on your instructions/orders or instructions/orders purported to emanate from you and you indemnify Hikers Edge against all and any claims, liabilities, losses, costs, fines, damages and expenses incurred (whether directly or indirectly) by you, arising as a result of the fact that Hikers Edge has acted on your instructions/orders or instructions/orders which purported to emanate from you.
  • Orders, confirmation & delivery

    1. The advertising of Products via the Website merely constitutes an invitation by Hikers Edge for you to make an offer to purchase Products and we remain entitled to reject any order without giving reasons therefore and without any liability to you.
    2. As erroneous information and/or prices may be displayed on this Website from time to time, you agree that Hikers Edge cannot be held liable for any inaccurate information and/or prices published on the Website, save where such liability arises from the gross negligence or wilful misconduct of Hikers Edge, its employees, agents or authorised representatives. We will not under any circumstances whatsoever be obligated to sell a Product at such erroneous price displayed on the Website.     3. Once you have selected the Product you wish to purchase and submitted your order to Hikers Edge, you will be given the opportunity to review the entire transaction and correct any mistakes, before electing whether to withdraw from the transaction or proceed with the transaction. By clicking on the “proceed” or “purchase” or similar “final submit” button you are deemed to have submitted an offer to purchase the Product/s selected by you (“order”) and the order can be withdrawn by you.
    4. Hikers Edge reserves the right to cancel the order for any reason on notice to you and without any liability to you. Receipt of a confirmation of the order (which only constitutes acceptance by Hikers Edge to process the order) will be sent to you once we receive your order. Although the Website is set up to confirm receipt of orders, technical or other problems may delay or prevent such confirmations. DO NOT resend your instruction if you do not receive a confirmation from us as this may lead to a duplicate transaction for which you will be held liable.
    5. Please note: A transaction will only be deemed to have been concluded once the Product/service in question has been delivered in accordance with the selected delivery option or agreed process. Hikers Edge will indicate the acceptance of your order by delivering the Products to you or allowing you to collect them, and only at that point will an agreement of sale between you and Hikers Edge come into effect (the “Sale”). This is regardless of any communication from Hikers Edge stating that your order or payment has been confirmed. Hikers Edge will indicate any rejection of your order by cancelling it and, as soon as possible thereafter, refunding you for any amount already paid.
    6. We reserve the right to withhold approval and / or cancel orders at our sole discretion.
    7. Placing Products in a wish list or shopping basket without completing the purchase cycle does not constitute an order for such Products, and as such, Products may be removed from the shopping basket if stock is no longer available or the price thereof might change without notice to you. You cannot hold Hikers Edge liable if such Products are not available or are not available at the particular price when you complete or attempt to complete the purchase cycle at a later stage.
    8. Delivery times are estimates only and we are not liable for any late deliveries.
    9. We reserve the right to verify the identity of any purchaser or the payment method used. This may entail you being required to, amongst other, send us a copy of your identity document, proof of residence, copy of front and back of your credit card. Failure to do so may result in us cancelling the order without reason. If Hikers Edge approves your application you may be required to sign additional terms & conditions, which will form the basis of Hikers Edge’s agreement with you. If you do not agree to these additional terms & conditions then your application will be cancelled and you will not be entitled to use or access the product or service you have subscribed to.
    10. Risk in the products shall pass to you or your authorized representative on delivery.
  • Performance and availability of Products

    1. Hikers Edge endeavours to execute all orders within the time period notified but by accepting these Terms, you acknowledge and agree that delivery of orders can from time to time fall outside of these time periods due to a number of reasons out of our control including but not limited to logistic delays. By accepting these Terms and transacting on the Website, you acknowledge that no liability is incurred by Hikers Edge in these instances.
    2. You acknowledge that stock of all Products on offer is limited and accept that the display of Products is not necessarily a guarantee that a Product is available.
    3. When Products are no longer available Hikers Edge will notify you and you will be entitled to a refund of the amount paid by you for such Products. Whilst Hikers Edge will take all reasonable efforts to monitor stock levels, we cannot guarantee the availability of stock and we will only be liable for delivery of the Products when the Products are available. Should the Products no longer be available, you shall be entitled to either be credited or refunded for any payments already made by you.

  • Payments

    1. We accept payments via EFT, credit card, debit card or EFT.
    2. Debit/Credit card payments:
      1. We only accept MASTERCARD and VISA credit and debit cards. We will debit the total value of your online order against the payment card tendered by you during the check-out process.
      2. Payment will be effected on acceptance of your order and prior to delivery.
      3. By submitting your order, Identity Number and payment card details you warrant that you are over the age of 18 (eighteen) and that you are fully authorised to make payment with the payment card and that there are sufficient funds available to pay for the order.
      4. Where payment is made by credit card, we may require additional information in order to authorise and/or verify the validity of payment. In such cases we reserve the right to withhold delivery until such time as the additional information is received by us and authorisation is obtained by us for the amounts. If we do not receive authorisation your purchase of the Products will be cancelled.
    3. EFT/Instant EFT payments:
      1. If payment for the full amount does not reflect in our bank account within 14 days, your order will be cancelled. Payments for orders made via Instant EFT will be processed in the same way that Credit Card orders are processed.

  • Returns

    1. Please refer to the Help Desk (returns and Refunds policy), which sets out our policy regarding returns or exchanges.
    2. Nothing on our refunds policy or these Terms in any way limits your rights in terms of section 56 (read with section 55) of the CPA.
  • Cancellations

    1. You are, in terms of section 44 of the Electronic Communications and Transactions Act 25 of 2002 (“ECT Act”) entitled to cancel, without reason and without penalty, your order for the Products within 7 (seven) days of receipt of the Products. In such an event –
      1. you will receive a full refund of the purchase price within 30 (thirty) days of the date of your cancellation of the order;
      2. you undertake not to utilise the Products;
      3. your agreement of purchase will be deemed to have been cancelled, and
      4. you will be liable, in terms of section 44(2) of the ECT Act, for the direct costs of returning the products, such as courier and/or shipping charges.
    2. If for any reason you would like to cancel an order this may be done by contacting our Customer Care Line on +27 76 697 9617. You will only be able to cancel orders up to 17:00 on the day prior to the date of delivery.
    3. If you cancel your order later than 7 (seven) days of receipt of the Products, we reserve the right to debit your payment card for the delivery fees in respect of any late cancellations. If you cancel your payment for any reason or if your payment card should cease to be valid for whatever reason, you will nevertheless be bound to pay the full purchase price, including all costs incurred by us relating to the recovery thereof. Without prejudice to any other rights or remedies in law, we reserve the right to cancel forthwith any sale and/or your registration in the event of your breach of any of these Terms.
  • Gift Cards & Vouchers

    1. Hikers Edge may from time to time make physical or electronic gift cards (“Gift Cards”) and promotional vouchers or discounts (“Vouchers”) available for use on the Website towards the purchase of the Products. Gift Cards and Vouchers can only be redeemed while they are valid and their expiry dates cannot be extended.
    2. Gift Cards:

      1. Gift Cards are available for purchase online and in store.
      2. Gift Cards that are purchased online by registered users are valid for a period of 3 (three) years after Sale. If your Gift Card has not been used within that period, it will expire and you will not be entitled to a refund.
      3. Gift Cards cannot be used to buy other Gift Cards. They do not accrue interest and are not refundable for cash once purchased. If your Gift Card value is insufficient for the order you wish to place, you may make up the difference by paying via one of our other payment methods as provided for in these Terms.
    3. Hikers Edge is not responsible for any loss or unauthorised use of a Gift Card, after it has delivered the Gift Card to you or the email address nominated by you.
    4. Vouchers:

      1. Vouchers are issued in Hikers Edge’s sole discretion and we reserve the right at any time to correct, cancel or reject a Voucher for any reason. Users do not have a right to Vouchers. Vouchers are issued under specific terms and conditions regulating when and how they may be used.
      2. As a general rule, and unless specified otherwise on the specific Voucher itself:
        1. each Voucher can only be used once;
        2. only one Voucher can be used per person per promotion/campaign on the Website;
        3. a Voucher must be used at check-out. It cannot be used later on existing orders; and
        4. the value of the Voucher will be set off against the value of your shopping basket and the balance remaining, if any, will be payable by you.
      3. Vouchers cannot be used to buy Gift Cards or other Vouchers, and cannot be exchanged or refunded for cash or credit. If for any reason a Voucher does not reflect on the final amount due from you at check-out, you can contact Hikers Edge to confirm if the Voucher is still valid. If the voucher is still valid, you can choose whether to cancel the order and place it again with the Voucher, or you can complete the current order and use the Voucher on your next order.
      4. Hikers Edge is not responsible for any loss or unauthorised use of a Voucher.

Booking Terms & Conditions

Please take the time to read and understand the conditions of booking set out below prior to booking a trip with us. We strongly recommend that you also read the Essential Trip Information relating to your trip prior to booking to ensure that you understand the itinerary and physical demands of the trip you are undertaking.

1. Our contract

All bookings are made with Hikers Edge PTY (LTD). By booking a trip with us you are deemed to have agreed to these Booking Conditions (which constitutes the entire agreement between you and us) and your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice.

2. Validity

Dates and itineraries are valid until 31 December 2018. Beyond 31 December 2018 dates and itineraries are indicative only.

3. Deposit requirement

You are required to pay a non-refundable deposit of ZAR 5000 per person per trip for your booking to be confirmed. If your booking is made within 56 days of the departure date then the full amount is payable at the time of booking.  Please note that different deposits amounts are required for selected trips.

4. Acceptance of booking and final payments

If we accept your booking we will issue a confirmation invoice.  A contract will exist between us from the date we issue the confirmation invoice or if you book within 30 days of departure the contract will exist when we accept your payment.  Please refer to your booking confirmation invoice for details regarding final payments. Payment of the balance of the trip price is due 56 days before the departure date. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled.

5. Prices & surcharges

Our trip prices are subject to variable and seasonal pricing, both of which are standard practice within the travel industry. This means our trip prices may vary at any time in accordance with demand, market conditions and availability. It is likely that different passengers on the same trip have been charged different prices. Your best option if you like the price you see is to book at that time. Any reduced pricing or discounts that may become available after you have paid your deposit will not apply. If you wish to cancel your booking to take advantage of a cheaper price, full cancellation conditions apply. The most up to date pricing is available on our website. Prices are based on currency exchange rates as of June 2017; note that prices may vary depending on which currency the booking is made. We reserve the right to impose surcharges up to 56 days before departure due to unfavorable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action should require us to do so.  In such instances we will be responsible for the any amount up to 2% of the trip price and you will be responsible for the balance. If any surcharge results in an increase of more than 10% of the trip price you may cancel the booking within 14 days of notification of the surcharge and obtain a full refund. Air Passenger Duty is included in the price of your air inclusive trip. Please note that a surcharge may be applied to all purchases made by credit card.

6. Your details

In order for us to confirm your travel arrangements you must provide all requested details with the balance of the trip price. Necessary details vary by trip; they include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. On some more demanding trips we also require you to complete and forward a Self-Assessment form.  Failure to provide requested details may result in additional charges or non-refundable cancellation of your trip.

7. Cancellation by the traveller

If you cancel some or all portions of your booking cancellation fees will apply.  A cancellation will only be effective when we receive written confirmation of the cancellation.  If you cancel a trip:

  • 56 days or more prior to departure, we will retain the deposit;
  • Between 31 and 55 days prior to departure, we will retain the deposit or 50% of the total booking cost; whichever is greater, and
  • 30 days or less prior to departure, we will retain 100% paid by you in connection with the booking.

Your booking consultant will advise if differences apply. If you leave a trip for any reason after it has commenced we are not obliged to make any refunds for unused services.  If you fail to join a tour, join it after departure, or leave it prior to its completion, no refund will be made. The above cancellation fees are in addition to fees which may be levied by accommodation providers, travel agents or third party tour and transport operator fees.

8. Cancellation by us

We may cancel a trip at any time up to 56 days before departure, subject to clause 14.  We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary. If we cancel your trip, you can transfer amounts paid to an alternate departure date or receive a full refund.  In circumstances where the cancellation is due to external events outside our reasonable control refunds will be less any unrecoverable costs.  We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.

9. Booking amendments

If you wish to transfer from one trip to another or transfer your booking to a third party you must notify us at least 56 days prior to the proposed departure date.  A fee of ZAR 2500 per person per change will apply (in addition to any charges levied by hotels, ground operators or airlines).  If you notify us less than 56 days prior to the proposed departure date the refund policy applicable to cancellations will apply.  Transfers to a third party are only permitted where the transferee meets all the requirements in relation to the trip, and transfers to another departure can only be made to a departure within the current validity period.

Amendments to any other arrangements made in conjunction with your trip will incur an ZAR 1500 administration fee per booking per change. This fee is in addition to any charges levied by hotels, ground operators or airlines.   No amendments are permitted to your booking within 10 days of departure.

10. Inclusions

The land price of your trip includes:

  • All accommodation as listed.
  • All transport listed.
  • Sightseeing and meals as listed.
  • The services of a group leader.

11. Exclusions

The land price of your trip does not include:

  • International or internal flights unless specified
  • Kitty.
  • Airport transfers, taxes and excess baggage charges unless specified
  • Meals other than those specified.
  • Visa and passport fees.
  • Travel insurance.
  • Optional activities and all personal expenses.

12. Overland kitty

On some Overland trips you are required to contribute to a Kitty. The Kitty is a compulsory on-ground payment put into a central fund and overseen by the travellers and the crew. It helps fund accommodation, camp meals and some included activities. Kitty amounts are subject to change so please check our website for the up-to-date amount 48 hours prior to your trip commencement.

13. Age & Health requirements

Minimum Age: For the majority of our trips the minimum age is 12 at the time of travel.  All travellers under the age of 18 must be accompanied by a legal guardian, or in lieu of a legal guardian, by an escort over the age of 18, appointed by their legal guardian.  The legal guardian or their designee will be responsible for the traveller under the age of 18’s day to day care. If a legal guardian elects to designate an escort in their lieu, they will be required to complete and sign a relevant document, to delegate their authority.

Please note we cannot guarantee triple or adjoining rooms for families; accompanying adults may be required to share with others in the group on a twin share basis.

Variations:  A minimum age of 18 applies to many Overland adventures, while a lower minimum age applies to Family trips and Short Break Adventures. Please check with your consultant at the time of enquiry. All bookings for our Family trips must include a child under the age of 18.

Maximum Age: For the majority of our trips we have no upper age limit though we remind you that our trips can be physically demanding and passengers must ensure that they are suitably fit to allow full participation.     We are able to provide details on mandatory health requirements; however, we are not medical experts. It is your responsibility to ensure that you obtain proper and detailed medical advice at least two months prior to travel for the latest health requirements and recommendations for your destination.

14. Small groups & combination trips

Our trips are guaranteed to depart once they have one fully paid traveller unless minimum group size specifically states otherwise. This means at times we can have groups with small numbers of travellers.  Many of our trips are designed to fit with other departures to create a longer “combination” trip; this means that some of your group may have already been travelling together for some weeks when you commence your trip.  If you would like to know how many people are booked on your trip or any combination trip it is part of please ask prior to making your booking.

15. Passport and visas

You must carry a valid passport and have obtained all of the appropriate visas, permits and certificates for the countries which you will visit during your trip. Your passport must be valid for 6 months beyond the duration of the trip. It is your responsibility to ensure that you are in possession of the correct visas, permits and certificates for your trip.  We are not responsible if you are refused entry to a country because you lack the correct passport, visa or other travel documentation.

16. Travel insurance

Travel insurance is mandatory for all our travellers and should be taken out at the time of booking.  Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of ZAR 5 000 000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide proof of your travel insurance on the first day of your trip; you will not be able to join the trip without it.  If you obtain travel insurance through us you acknowledge that you are satisfied with the level of insurance we have arranged.

17. Flexibility

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.

18. Change of itinerary

While we endeavor to operate all trips as described we reserve the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary.

Before departure:  If we make a major change we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting an alternative tour offered.

After departure:  We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control.   In such emergency circumstances the additional cost of any necessary itinerary alterations will be covered by you. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itinerary such as visas, vaccinations or non-refundable flights.

19. Authority on tour

Our group trips are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If you fail to comply with a decision made by a group leader, or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund.  We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our responsible travel guidelines.

20. Acceptance of risk

You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. You will be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However it is also your own responsibility to acquaint yourself with all relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel.

21. Limitation of liability

We contract with a network of companies, government agencies and individuals to assist in the running of our trips as agent for these third parties.  We are not responsible for the acts and omissions of these third parties.

To the fullest extent permitted by law:

– any liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a trip, or any breach of the Booking Conditions, is excluded;

– you release us and our officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip; and

– any condition or warranty which would otherwise be implied by law into these Booking Conditions (Implied Warranty), is excluded.

To the extent an Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute discretion): (i) the provision of a similar trip to an equivalent value; or (ii) a refund of the total amount received by us from you in connection with your booking.

Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive or exemplary damages.

22. Optional activities

Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance given by your group leader or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and activity provider.

23. Claims & complaints

If you have a complaint about your trip please inform your group leader or our local representative at the time in order that they can attempt to rectify the matter. If satisfaction is not reached through these means then any further complaint should be put in writing to us within 30 days of the end of the tour.

24. Severability

In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.

25. Photos and marketing

You consent to us using images of you taken during the trip for advertising and promotional purposes in any medium we choose.  You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes.

26. Privacy policy

Any personal information that we collect about you may be used for any purpose associated with the operation of a Trip. We may also use this personal information or to send you marketing material in relation to our events and special offers and, if you do not fully complete any subsequent or additional booking with us, to contact you by email or by telephone (including by SMS) to remind you that you have an incomplete booking and prompting you to visit our website to complete your booking. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the Trip. We will otherwise treat your details in accordance with our privacy policy (available for viewing on our Website).

27. Applicable law

The laws of the Republic of South Africa govern these Booking Conditions to the fullest extent allowable.  Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of  the Republic of South Africa. All Parties hereby consent and submit to the exclusive jurisdiction of the North Gauteng High Court of the Republic of South Africa in any dispute arising from or in connection with these booking conditions.
